A Violation of any of the below Terms of Service will result in action by Uplodes up to and possibly including the termination of your account, with or without warning.

Uplodes is a service that provides online storage for a variety of different file types. We offer two 1GB (gigabyte) plans, both with a different billing option. Uplodes reserves the right to cancel any account for any reason or no reason at all. Uplodes provides secure online storage that abides to our terms and conditions. Uplodes reserves the right to change these terms and conditions at any time. Uplodes members are entirely liable for all activities conducted through their account. The following rules apply while using Uplodes services:

1. Uplodes is not responsible for the content of any member’s storage space. We reserve the right to remove any accounts that are in violation of our terms and conditions. Members will be held legally responsible for the contents of their web pages including but not limited to use of copyrighted material without the permission of the author or linking to material considered indecent for minors. The use of Uplodes for illegal purposes is strictly forbidden and any account found to be or believed to be, in Uplodes sole discretion, violating the law may be removed without notice. Service will be terminated and files removed from our servers. No refunds will be given for accounts removed for violating these terms of service. Uplodes membership will be revoked if any of the following activities occur:
   • Adult or Pornographic related
   • Hate, Bigotry, and/or Intolerance
   • Warez or Software Piracy related
   • Music Piracy Related
   • Hacking Related
   • Making available copyrighted software which has been "cracked" (e.g., copyright protection for the software has been removed)
   • Making available serial numbers for software which can be used to illegally validate or register software.
   • Making available tools which can be used for no purpose other than "cracking" software.
   • Spamming through links to your stored content.
   • Anything related to illegal activity
   We do not allow any type of programs, software, or MP3 files on our server unless you are the full owner and have all rights to the file. This includes files with the following extensions: our server .rar, .arj, .tar, .mp3 or .exe.
2. You and any person who has access to your account must evaluate, and bear the risk associated with, the accuracy, completeness or usefulness of any content. Uplodes reserves the right to remove files which are deemed in Uplodes sole discretion harmful, offensive, or otherwise in violation of the rules or any rules or policies Uplodes has in place at the time.
3. All 1GB plans are limited to 10GB of monthly data transfer. This includes both uploads and downloads of all files to and from each Uplodes 1GB plan. A Moxyfy user may possess multiple 1GB plans, each subject to it's own 10GB monthly data transfer limit.
4. Gigabyte or GB is an SI-multiple of the unit byte for digital information storage. One gigabyte is 1073741824 bytes.
5. You or Uplodes may terminate your Account at any time for any reason. To cancel your Uplodes membership and account, log in and visit your Account section. Click on cancel account. You will be redirected to Paypal where you will need to cancel your subscription. Uplodes service will end on the last day of your paid billing cycle.
6. The Uplodes service is provided to you “as is” and “as available” with no warranty to the maximum extent permitted by law, Uplodes disclaims all warranties or conditions of any kind, whether express or implied. Including but not limited to, implied warranties of merchantability and fitness for a particular purpose, title, non-infringement, the implied condition of satisfactory quality and implied warranties arising from course of dealing or course of performance you acknowledge that if you rely on any information or content on the service, you do so solely at your own risk.
7. Uplodes will not be liable for any of its services. We have the right to cancel our service at any time, and we will not be liable for any files that are lost and/or corrupted which may occur (including, for example, from a system crash, security breach, or hard disk failure). Uplodes does create regular backups at frequent intervals of all stored content and will do it’s best to replace any lost files. To the full extent permissible under the applicable law, Uplodes shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use Uplodes services. You agree, at your own expense, to indemnify, defend and hold harmless Uplodes and its affiliates, officers, directors, employees, consultants, agents, suppliers and licensors from and against any and all third party claims, liability, damages, losses and/or costs (including but not limited to reasonable attorneys’ fees) arising from or relating to: (a) your failure to comply with these terms of use; (b) your infringement or violation of any intellectual property or other right of a third party; or (c) your violation of any applicable law.
8. Users can upgrade their storage accounts at anytime by purchasing additional 1GB plans. These accounts (plans) can all be accessed from the same user account. Each plan will have its own separate billing cycle based on the date of purchase in accordance with Paypal’s subscription service.
9. These terms of use shall be governed by and construed in accordance with the laws of the State of California. Both parties submit to the personal jurisdiction in California. These Terms of Use constitute the entire agreement between you and Uplodes with respect to the service. You acknowledge and agree that you have read and understand the provisions of these terms of use. By using this site, you consent to the terms of use described herein, including any updates. Uplodes reserves the right to vary these terms of use from time to time and will update the “Effective Date” section above when such changes are made.
